CONSTITUTIONAL CONDITIONS - Constitution of Luxembourg

Binding referendum requires constitutional amendment. Consultative referendum expressly provided.

 

PROCEDURE

On 8 December 1997, the government submitted the ratification bill to the Council of State, who decided on 12 May 1998 that the Amsterdam Treaty was not in conflict with any of the articles of the constitution and therefore an amendment of the constitution not to be required (Doc. Parl. No. 4381). The Council referred to Art. 49bis and argued that the treaty implied a transfer of national sovereignty to an international institution. The required 2/3 majority was obtained on 9 July (55 in favor, 4 abstentions).
